This Disclaimer governs your use of the OutMyWindow mobile application (the "App"), operated by x8 Data Company LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to this Disclaimer. If you do not agree, you must not use the App.
1. General Information
OutMyWindow is designed to enhance your in-flight experience by providing information about your flight path and nearby points of interest, including through two-dimensional and three-dimensional map views and simulated visual perspectives.
All information provided through the OutMyWindow App is for informational and entertainment purposes only.
The information provided by OutMyWindow does not constitute professional, aviation, or navigational advice.
2. No Aviation or Navigation Use
OutMyWindow is not an aviation tool and is not intended for navigation or operational use. The App should not be used for:
- Flight navigation
- Aviation decision-making
- Safety-related purposes
OutMyWindow is not affiliated with, endorsed by, or approved by the FAA or any aviation authority.
Any cockpit-style, pilot-style, first-person, or three-dimensional view in the App is a visual simulation for passenger entertainment only. It is not a cockpit instrument, synthetic-vision system, navigation display, or representation of the actual view, terrain clearance, aircraft attitude, weather, traffic, or flight conditions. It must never be used by pilots, crew members, or any other person for operating or navigating an aircraft or making aviation or safety decisions.
You are responsible for remaining aware of your surroundings at all times and complying with all flight crew instructions, airline policies, and safety regulations. Do not allow use of the App to distract from safety protocols.
3. Data Accuracy and Limitations
OutMyWindow relies on third-party data sources, including flight tracking data and geographic information. As a result:
- Aircraft position may be delayed or inaccurate
- Points of interest may not appear at the expected time or location
- Three-dimensional terrain, camera perspectives, visibility, line-of-sight, and simulated views may be approximate, incomplete, distorted, or different from real-world conditions
- Some features may be unavailable or incomplete
We do not guarantee the accuracy, completeness, or reliability of any information provided in the App.
You agree that you will not rely on the App for any decisions, and we are not liable for any outcomes resulting from such reliance.
4. Experimental Offline Mode
OutMyWindow includes an Experimental Offline Mode that uses your device’s location services when live flight data is unavailable. This feature is inherently limited and may not function as expected.
- It depends on your device’s ability to obtain a GPS signal
- GPS accuracy at high altitude (e.g., during flight) may be limited or unreliable
- The App has limited control over how your device determines location
- The feature may require user actions (such as opening the App periodically or using it before takeoff) to function properly
- In some cases, the feature may fail entirely or provide inaccurate results
By using Experimental Offline Mode, you acknowledge that:
- Performance may vary significantly by device and conditions
- The feature may not work during all or any portion of your flight
5. Third-Party Dependencies
The functionality of OutMyWindow depends on external data providers and services. If these services experience outages, delays, or changes:
- The App may be partially or fully unavailable
- Certain features may not function as expected
We do not guarantee that the App will be available at all times or without interruption.
6. Paid Features Disclaimer
OutMyWindow may offer paid features, including subscriptions and one-time purchases that provide access to enhanced functionality.
- Access to paid features does not guarantee uninterrupted service or availability
- Features may change, be modified, or be discontinued at any time
- Availability of the App and its features depends on external systems and services
- Purchase validation, entitlement status, renewals, cancellations, and refunds may depend on Apple, Google, RevenueCat, and other third-party systems
7. Disclaimer of Warranties
YOUR USE OF OUTMYWINDOW IS ENTIRELY AT YOUR OWN RISK. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
By using the App, you acknowledge and accept that:
- The experience is based on estimated and third-party data
- Information may not reflect real-world conditions
- The App may not function at all times
- Map rendering, three-dimensional views, location services, network activity, and extended screen use may increase battery consumption, processor and memory use, mobile data use, device temperature, or the likelihood of reduced performance or app instability
- We are not responsible for device battery depletion, overheating, reduced performance, hardware failure, data charges, or other device-related issues resulting from use of the App
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, SERVICE INTERRUPTIONS, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY WITHIN THE APP
9. Indemnification
You agree to indemnify, defend, and hold harmless x8 Data Company LLC and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the App, or your violation of this Disclaimer.
10. Governing Law
This Disclaimer shall be governed by and construed in accordance with the laws of the State of Texas and the United States, without regard to its conflict of law provisions.
11. Dispute Resolution
Any dispute arising out of this Disclaimer or your use of the App is subject to the binding arbitration and class action waiver provisions detailed in our Terms of Service.
12. Integration with Other Policies
Your use of the App is also governed by our Privacy Policy and Terms of Service, which are incorporated by reference.
13. Severability
If any provision of this Disclaimer is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14. Changes to this Disclaimer
We reserve the right to update or modify this Disclaimer at any time without prior notice. Any changes will be effective immediately upon posting the updated Disclaimer within the App.
Your continued use of the App after any such changes constitutes your acceptance of the updated Disclaimer.
